 今週の珍言、名言、問題発言を振り返る。政府による「働き方改革」が頓挫しかかっている。裁量労働制の対象拡大を含む「働き方改革」関連法案について、その元となった労働時間の実態調査に不備があったことが次々と発覚しているからだ。
 まず、安倍首相は1月29日の衆院予算委員会で「裁量労働制で働く方の労働時間の長さは、平均的な方で比べれば一般労働者よりも短いというデータもある」と答弁していたが、このデータがまったくのガセだった。「1カ月で最も長く働いた日の残業時間」(一般労働者)と「1日の労働時間」(裁量制の労働者)という全く違う質問のデータを比較して、「一般労働者よりも短い」と言っていたのだ。

 安倍首相は2月14日にこのデータを引用した国会答弁を撤回。首相が国会で答弁を撤回して謝罪するのは異例のことだ。厚生労働省は15日の衆院予算委員会で、このデータが首相答弁の「唯一の根拠」だったことを明かしている(日刊スポーツ 2月16日)。安倍首相は20日の衆院予算委員会では「(答弁案が)厚生労働省から上がってくる。それを参考にして答弁した」「担当相は厚生労働相だ。全て私が詳細を把握しているわけではない」と述べ、答弁撤回に至った責任は厚労省にあるとした(朝日新聞デジタル 2月20日)。
 裁量労働制をめぐる残業時間のデータについては、多くの不備が続々と見つかっている。たとえば、「1日の残業時間」として「45時間」と書かれていたりするのだからメチャクチャだ。安倍首相は20日に「データを撤回すると言ったのではなく、答弁を撤回した」と強弁していたが、データそのものがおかしいことが再び明らかになった。さらに加藤勝信厚労相が「なくなった」と国会で説明していた調査票の原本が、厚生労働省の地下の倉庫で見つかっている。
 共産党の志位和夫委員長は「国民に謝罪した以上、(法案提出を)断念し、調査することが総理の責任の取り方だ」と批判している(朝日新聞デジタル 2月22日)が、安倍首相は法案提出の方針を堅持している(時事ドットコムニュース 2月22日)

 21日、過労が原因で子どもや夫を亡くした遺族が厚生労働省を訪れ、政府が今国会で提出する方針の「働き方改革」関連法案について、裁量労働制の対象が拡大されると多くの若者が対象になり、過労死の増加につながるとして白紙撤回を求めた。あれ? 「働き方改革」って長時間労働をやめるためのものじゃないの?

 裁量労働制は実際の労働時間にかかわらず、一定時間働いたとみなして残業代込みの賃金を払う制度のこと。ブラック企業被害対策弁護団代表を務める弁護士のささきりょう氏のツイートがわかりやすい。「早く帰っても8時間働いたとみなすことは裁量労働制に関係なくできるよ。でも、8時間より多く働いたのに8時間とみなすことは裁量労働制でしかできないよ。あと、裁量労働制という名前だけど、仕事量には裁量はないよ」(2月22日)。

 希望の党の山井和則氏は、20日の国会で「過労死のご遺族は過労死促進法と呼んでいるんですよ」と安倍首相に詰め寄った(TBS Newsi 2月20日)。裁量労働制を「定額働かせ放題」と表現した健康社会学者の河合薫氏は、今国会で提出される法案について「表向きには裁量権があるように見えるが、企業側に都合良く使われる可能性が高い悪法である」と指摘している(Yahoo!ニュース個人 2月15日)。
 早朝出勤も残業も休日出勤も、すべて裁量を与えた社員が自発的に行っているものだと企業が主張すれば、それが通ってしまう。それでいて賃金は一定なので、企業にとっては人件費の抑制につながる大きなメリットがある。経団連の榊原定征会長は「制度が適用される範囲をできるだけ広げてほしい」と2015年に語っていた。安倍首相は今国会を「働き方改革国会」と名付けているので、絶対に後には引けないと考えているだろう。今後、「働き方改革」関連法案がどうなるかに注目していきたい。
